The following terms and conditions (including pricing) apply to all SCA Guide Type 6 arrangements. Unless modified by the following, all terms and conditions (including pricing) set forth elsewhere in this Guide (or applicable tariff) apply.
1. Term and Renewal Options: Prior to March 1, 2004, Customer must enroll in a MCI Services Agreement (Term Plan) for a term of either one, two or three years (Initial Term.) The terms and conditions applicable to an SCA Guide Type 6 are separate from, and in addition to, terms and conditions that apply to the Term Plan with which an SCA Guide Type 6 is associated.
2. Description of Service: SCA Guide Type 6 service will consist of Long Distance Voice Services, domestic Frame Relay Services, U.S. Private Line Services, Global Private Line, dedicated interstate access service, Audio Conferencing, Net Conferencing, Data Center Colocation, Internet Dedicated Services, exchange service provided by the Company or an affiliate of the Company pursuant to tariff, if applicable, and non-regulated services provided by the Company or an affiliate of the Company.
3. Volume Commitment: The provisions of the Term Plan will apply except that the Customer may elect an Term Plan annual volume commitment of $600, $1,200, $3,000, $6,000, $12,000, $24,000, $36,000, $48,000, $60,000, $84,000, $120,000, $180,000, $300,000, $600,000, $900,000, or $1,200,000. For purposes of this SCA Guide Type 6, “Monthly Volume Requirement (MVR)” is defined as an amount equal to one-twelfth of the Customer’s annual volume commitment.
4. Rates and Charges: Except as set forth in this Section, rates established elsewhere in this Guide, as these may be amended from time to time, will apply.
4.1 On-Net Voice Services:
4.1.1 Domestic Service: The Customer will be charged the following per-minute rates for On-Net Voice Services Outbound Service, including Calling Card, usage that originates in the U.S. Mainland and Hawaii and terminates in the U.S. Mainland, Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, Guam, and CNMI and On-Net Services Inbound Service usage that originates in the U.S. Mainland, Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, Guam, and CNMI and terminates in the U.S. Mainland and Hawaii, based on origination type for Outbound Service usage and termination type for Inbound Service and the Customer’s term of the service:

4.1.2 International Service: The Customer will be charged the following per-minute rates for On-Net Voice Services Outbound Service, including Calling Card, usage which originates in the U.S. Mainland, Hawaii and the U.S. Virgin Islands and terminates in the following locations, based on origination type:
The Customer will be charged the following per-minute rates for On-Net Voice Services International Toll Free Service usage which originates in the following locations and terminates in the U.S. Mainland, Hawaii and the U.S. Virgin Islands, based on termination type:
4.2 Access: The Customer will be charged a $100 monthly recurring per-circuit Local Access Channel charge for Type 1 DSO (Hubless) Access (DS0) and a $200 monthly recurring per-circuit Local Access Channel charge for Type 1 DS1 Access (DS1) local access circuits.
The Customer will be charged the following monthly recurring per-circuit Local Access Channel charges for Type 3 DS0 and Type 3 T-1 Digital Access local access circuits, based on the location of the terminating Customer Premises, circuit type and standard monthly recurring per-circuit Local Access Channel charges.
The following charges apply for circuits with terminating Customer Premises located in all states except Ohio, Illinois, Indiana, Minnesota and Wisconsin:

For purposes of Access service provided under this SCA Guide Type 6 only, the following definitions apply: Type 1 service is service in which the local loop is furnished in whole via Company-owned facilities; Type 3 service is service in which the local loop is not furnished in whole via Company or Company‑affiliate facilities.
4.3 Enterprise Mobility Dial Access:
4.3.1 Monthly Recurring Charges: For Customers who renew existing Enterprise Mobility Dial Access North American Flat-Rate pricing plan service under this SCA type, the following monthly recurring charges apply based on the Customer’s term of service under this SCA type and Included Hours per Month:

4.3.2 Non-Recurring Charges: A $1.50 Excess Usage charge applies per hour of usage that exceeds the Customer’s Included Hours Per Month.
5. Discounts:
5.1 Private Line Services: The Customer will receive the following discounts, in addition to Network Pricing Plan (NPP) discounts as set forth in Section 7, on monthly recurring charges for DS0 (Digital Signal Level 0) and DS1 (Digital Signal Level 1) and Tier A DS3 Private Line Service circuits ordered and installed during the Initial Term, based on circuit type, annual volume commitment and the Customer’s SCA Guide Type 6 term of the service:

The provisions of the NPP apply, except that the Customer will receive NPP discounts at the 3-year and $50,000 term and volume level for term and volume commitments that which exceed that level.
For purposes of Domestic Private Line Service provided under this SCA Guide Type 6 only, the following definition applies: Tier A service is service in which the circuit is furnished in whole via Company or Company‑affiliate facilities.
5.2 Frame Relay Service:
5.2.1 Domestic: In addition to Domestic Discount Schedule discounts, the Customer will receive a 40 percent discount on monthly recurring port and PVC charges for domestic Frame Relay Service, excluding Economy Frame Relay Service. The Customer will receive Frame Relay Service Domestic Discount Schedule discounts at the 3-year and $100,000 term and volume level for term and volume commitments that which exceed that level.
5.2.2 International: Beginning April 17, 2003, Customers who enter into a new term commitment with a term of service which equals or exceeds one year or who extend the term of service of an existing term commitment by one or more years will receive the following discounts on monthly recurring port and PVC charges for international Frame Relay Service, based on term of service and annual volume commitment:

5.5 Additional Discounts: For Customers who subscribe to this SCA Type prior to January 1, 2003, in each monthly period in which the Customer uses three or more Qualifying Services, the Customer will receive a 3 percent discount on charges for the services set forth in Section 4.2, an additional 3 percent discount on services set forth in Section 5 and an additional credit applied against domestic, interstate usage equal to 3 percent of the standard tariffed rates in effect for the Customer's use of the services set forth in Section 6.2.
5.6 Internet Dedicated Services: The Customer will receive the following discounts on the Customer’s existing Internet Dedicated Services, excluding 768Kbps/T1 ISDN Back Up service, for which the Customer renews the term of service for the following terms under this SCA Type:

5.7 Data Center Colocation: In lieu of all other rates and discounts, new Customers of this SCA Type or existing Customers of this SCA Type who renew service under this SCA Type will receive the following discounts, based on term of service, on: (i) monthly recurring charges for: Backup & Restore Services; Business Continuity Services Cold Site Option and Hot Site Option; Business Continuity Customer Premises Option; Equipment Space Options, excluding Non-standard Cabinet Space; Inter-Cabinet Connectivity and Cabling; Internet Access Services Burstable, Tiered, and Shadow Services; Load Balancing Services; (ii) non-recurring charges for: Backup & Restore Services; Excess Usage for Internet Access Services Burstable and Shadow Services; Hot Site Option and Cold Site Option Business Continuity Services; and, (iii) per-hour charges for On-Site Technical Support/Hand and Eyes Support:

6. Credits:
6.1 Installation Charges: For Customers who subscribe to this SCA Type prior to January 1, 2003, the Company will waive the one-time, non-expedited installation charges and other one-time, non-recurring, standard charges associated with the implementation of domestic Frame Relay Services, DS0 (Digital Signal Level 0), DS1 (Digital Signal Level ) and T-1 Digital Access ordered during the Initial Term.
6.2 For Customers who subscribe to this SCA Type prior to January 1, 2003, the Customer will receive a credit applied against domestic, interstate usage equal to the following percentages of the standard tariffed monthly recurring and usage rates in effect for the Customer's exchange service provided by the Company or an affiliate of the Company, based on term of service:

6.3 Access: In each monthly period of the term of service, the Customer will receive a credit applied against charges for interstate service in an amount equal to the difference between the standard tariffed monthly recurring charge in effect for the Customer's intrastate private line service and the monthly recurring charge in effect for the Customer's Domestic Private Line Services at identical data speed and route mileage.
7. Classifications, Practices and Regulations:
7.1 Termination For Cause: Either party may terminate this SCA Guide Type 6 for cause. For purposes of this SCA Guide Type 6, “cause” shall mean: the Customer’s failure to pay any invoice within thirty (30) days after the date of the invoice; and/or breach by the other party of any material provisions of this SCA Guide Type 6 provided that written notice of the breach has been given to the breaching party, and the breach has not been cured within 30 days after delivery of such notice.
7.2 Underutilization: The provisions of the Term Plan will apply.
7.3 Early Termination: The provisions of the Term Plan will apply, except that the Customer will be billed and required to repay an amount equal to all discounts received by the Customer under Section 5.7 of this SCA Type.
7.4 Other Conditions: The Customer may not receive the benefits of any other term and volume discounts or other offerings on the services provided under this SCA Guide Type 6, other than Frame Relay Service Domestic Discount Schedule and Private Line Services Network Pricing Plan (NPP) discounts and Checkbook Promotion 2003, Dedicated IP Access with Cisco Router Promotion, Dedicated IP Access with Cisco Router and Redundant T1 Promotion, Dedicated IP Access with Efficient Router Promotion, Dial IP Access with Firewall Promotion, Frame Relay Upsize Promotion, Fund Promotion I, Fund Promotion II, Fund Promotion III, Install Waiver Promotion, International Outbound One Region Promotion, Internet Dedicated Port Install Parity Promotion, Internet Dial Office Install Promotion, Lit Building Access Migration Promotion, Internet DSL with Local and Long Distance Promotion, Local and Long Distance-Line Solution, Local and Long Distance Service Plus Optional Calling Plan/Local and Long Distance – Trunk Solution/Local and Long Distance Line Solution II, Local and Long Distance with IP-Line Solution, Local-to-Local Promotion, MCI Affinity Promotion, Verizon Loyalty Plus Promotion I, Verizon Loyalty Promotion II, Verizon Loyalty Promotion III, MCI Advantage Type 1 Bundles Discount Promotion, Premium Data Center Services – Empower Your Enterprise Promotion, and Regional Frame Relay Promotion.
